Terms of service

These terms are a working draft and must be reviewed and finalized by a licensed Virginia attorney before MyAgentless accepts real users or processes real payments.
1. Acceptance of terms
By creating an account or using MyAgentless, you agree to be bound by these Terms of Service. These terms constitute a binding legal agreement between you and MyAgentless, LLC, a Virginia limited liability company.
2. Platform nature
MyAgentless is a technology platform only. It is not a licensed real estate broker, agent, attorney, title company, or any regulated professional. Nothing on this platform constitutes legal advice. No attorney-client relationship is created.
3. Individual use only
You certify you are an individual human being registering for personal residential real estate purposes — not on behalf of any corporation, LLC, investment fund, iBuyer, or business entity. Violation constitutes a material breach entitling MyAgentless to liquidated damages of $10,000 per transaction, plus all actual damages, attorney fees, and costs. Providing false information constitutes fraud under Virginia law including Va. Code section 18.2-178.
4. Fees and payments
Seller listing fee: $5 per listing. Buyer offer deposit: $19 per offer (non-refundable if rejected or auto-rejected; credited if accepted). Offer unlock: $149 per listing, one-time, valid for life of listing. All fees processed through Stripe.
5. Auto-reject policy
Sellers may set a minimum offer floor. Offers below this floor are automatically rejected and the $19 buyer deposit is non-refundable. Buyers are notified of the floor before submitting.
6. Listing lifecycle
Listings are valid up to 180 days. No activity for 21 days triggers a warning. No activity for 28 days pauses the listing. No activity for 42 days removes the listing permanently. No refunds for removed listings.
7. Disclosure responsibility
Sellers are solely responsible for the accuracy of all disclosure information. MyAgentless provides disclosure tools for organizational purposes only and does not verify accuracy. Misrepresentation of material facts may expose sellers to civil liability under Virginia law.
8. Intellectual property
The MyAgentless name, logo, platform design, code, and all original content are the proprietary intellectual property of MyAgentless, LLC, protected by United States copyright and trademark law. Unauthorized reproduction, copying, scraping, reverse engineering, or use of MyAgentless intellectual property without written permission is strictly prohibited.
9. Limitation of liability
MyAgentless shall not be liable for any indirect, incidental, special, or consequential damages. Total liability shall not exceed the total fees paid by you in the 12 months preceding the claim.
10. Governing law
These Terms are governed by Virginia law. Disputes shall be resolved by binding arbitration in Augusta County, Virginia. Class action waiver: you waive any right to participate in a class action lawsuit against MyAgentless.
11. Modifications
MyAgentless may modify these Terms at any time. Material changes will be communicated via email. Continued use constitutes acceptance.
